1. Agreement to Terms

Welcome to WPStats. These Terms of Service ("Terms") govern your access to and use of the WPStats website at wpstats.dev and our WordPress plugin analytics platform (collectively, the "Service"), operated by Pixar Labs ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

WPStats provides a WordPress plugin and theme analytics platform that enables users to:

Track search ranking positions for WordPress plugins and themes on WordPress.org
Monitor keyword performance and discover new keyword opportunities
Analyze competitor plugins and themes
Access historical performance data and trends
Generate reports and receive email notifications
Access public statistics about the WordPress ecosystem

3. Account Registration

To access certain features of the Service, you must register for an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access or use

You must be at least 16 years old to create an account and use the Service.

4. Subscription Plans and Payment

4.1 Free and Paid Plans

The Service offers both free and paid subscription plans. Features and limitations vary by plan. Current plan details and pricing are available on our pricing page.

4.2 Billing

For paid subscriptions:

Subscriptions are billed in advance on a monthly or annual basis
Payment is processed through our third-party payment providers (Stripe or Paddle)
All fees are exclusive of applicable taxes, which may be added to your bill
Prices may change upon 30 days' notice

4.3 Free Trial

We may offer free trial periods for paid plans. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.4 Refunds

We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase or subscription renewal.

To request a refund, contact us with your account details. Refunds will be processed within 5-10 business days.

Additionally, we may provide refunds at our discretion for:

Service outages or technical issues that significantly impact usability
Billing errors

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

You will retain access to paid features until the end of your current billing period
Your account will revert to the free plan
Historical data associated with your account will be retained

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Transmit malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the Service or servers

6. Intellectual Property

The Service and its original content (excluding user content and public WordPress.org data), features, and functionality are owned by Pixar Labs and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content as necessary to provide the Service.

6.3 WordPress.org Data

Data sourced from WordPress.org is publicly available information. We do not claim ownership of this data. Our analysis, aggregations, and derived insights constitute our intellectual property.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF DATA

We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
Results obtained from the Service will be accurate or reliable
Any errors in the Service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXAR LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, USE, OR GOODWILL
SERVICE INTERRUPTION OR COMPUTER DAMAGE

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pixar Labs and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Service Modifications

We reserve the right to:

Modify or discontinue the Service (or any part thereof) at any time
Change features, functionality, or pricing with reasonable notice
Limit availability of certain features to specific subscription plans

13. Termination

Upon termination:

You may request export of your data within 30 days
Provisions that by their nature should survive termination shall survive

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pixar Labs is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

Updating the "Last updated" date
Sending an email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
